These Terms of Use ("Terms") govern your use of the Gallopa app ("the app") provided by Hypecent Limited ("we", "us"). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own non-commercial use, subject to these Terms and the App Store terms.

2. Ride safely

Gallopa is a tracking and training aid, not a safety device. Riding horses carries inherent risks. Always ride within your ability, wear appropriate safety equipment, and stay aware of your surroundings. Do not operate the app in a way that distracts you while mounted. You are solely responsible for your own safety and the welfare of your horse.

3. AI coaching is informational

The AI coach generates automated feedback about your riding from a video you provide. This feedback is for general, informational purposes only. It is produced by an AI model, may be inaccurate or incomplete, and is not a substitute for a qualified riding instructor, trainer, veterinarian or medical professional. Always use your own judgement and seek professional advice where appropriate.

4. Health and fitness

Any distance, speed, heart rate or other metric the app reports is an estimate and is not a medical measurement. Consult a professional before starting or changing any exercise routine.

5. Your content

You keep ownership of the videos, notes and ride data you create. By using the AI coaching feature, you grant us a limited license to upload and process your selected video solely to generate your analysis, as described in our Privacy Policy. Do not upload content you do not have the right to use, or that is unlawful.

6. Acceptable use

You agree not to misuse the app, including attempting to reverse engineer it, interfering with its operation, or using it to break any law or infringe anyone's rights.

7. No warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of results. We do not warrant that the app will be uninterrupted, error free, or that any feedback or metric is accurate.

8. Limitation of liability

To the maximum extent permitted by law, Hypecent Limited will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of, or inability to use, the app, including any reliance on AI feedback or recorded metrics.

9. Changes

We may update the app and these Terms from time to time. Continued use of the app after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which Hypecent Limited is established, without regard to conflict of law rules.
